Basis of the contract

The basis of the contract is the respective rented accommodation with the equipment features and details specified on the offer page of this website (or in Internet portals such as Booking.com / AirBnb / VRBO / ...).

By confirming the booking, the occupant accepts the terms and conditions and confirms that he/she has read, accepted and understood them.

Note for group bookings

The accommodation is booked in the specified location with the specified facilities and the included or excluded services for the specified period.

The prices quoted are for accommodation only, no parties, no events. The common areas (indoor and outdoor) are shared and are available to all guests.

In the case that one or more accommodations are booked by a group, the guest agrees that the assignment of the individual accommodations (e.g. with lake view, classic etc) within the group will be made by the host.

Note for guests staying at the Fontana Oasis Apartments in Castelnuovo del Garda

As we also welcome groups in Castelnuovo, it may happen that certain outdoor areas are temporarily rented by a group and are not available to other guests during this period.

However, we guarantee all our guests sufficient free space or access to leisure activities within the complex.

Object definition / Contractual purpose

We rent out a vacation apartment with the contractually agreed purpose purely as a “vacation apartment/holiday”. All infrastructure is designed for this purpose. Should you wish to use the vacation apartment for professional purposes, we assume no liability or responsibility for this if the existing infrastructure is not suitable for this.

Booking

Choose the resort, the apartment and the number of guests, as well as any additional services (pets, late check-out etc.). Enter the required personal data and select a payment method.

Read and agree to the general terms and conditions of sale and the privacy policy. Check your booking details and personal data provided.

After completing the booking, you will receive a confirmation email with all the details (choice of apartment, total amount, any additional services booked, booking details and any other information).

The customer agrees to read all accommodation information received by email, including check-in and check-out information, rules and instructions.

We are not responsible for information of any kind displayed on third party websites that are not related to the booking.

Prices and tourist tax

The prices shown are per apartment, for the number of persons indicated, category of room and selected travel dates.

The prices include tourist tax and the currently applicable VAT. Unless otherwise stated, additional services (parking, extra charge for pets, etc.) are not included in the price.

Any changes to the VAT rate will be automatically passed on and added to the stated price when the stay is invoiced (date of arrival).

Any modification or introduction of a new law or regulation imposed by the competent authorities will be automatically passed on and added to the indicated price when the stay is invoiced (date of arrival).

Payments and details of guest and fellow travellers

The guest is obliged to make all payments relating to the booking in full by the time of check-in. All persons, including infants and pets, staying in the accommodation must be registered by the guest.

Unregistered, unbooked and unpaid persons or pets are not permitted to use the accommodation

Changes and/or additions to persons or pets can be requested up to one day before arrival and must be confirmed by the host.

Failure to do so or failure to pay may result in immediate termination of the rental agreement without refund of any rental fees paid and/or a subsequent charge for the unregistered persons/pets plus a fee of 500 euros for violation of house rules.

Check-in/check-out

Check-In

Check-in / use of the accommodation is possible from 3 pm to 8 pm. Any arrival after 8 pm must be notified to the host and authorised by the host prior to arrival; additional charges will apply.

If the host does not authorise the later arrival, the arrival must take place by 8 pm, otherwise there will be a ‘NoShow’.

Check-Out

Must take place by 10 a.m. at the latest. Early check-in or late check-out, early removal or late return of the keys or use of the accommodation outside the specified times is only possible with the prior authorisation of the host, otherwise the guest may be charged additional costs for a further rental day or the costs for rebooking the subsequent guest.

Payment

Payment of the booking price can be made by bank transfer, Paypal, credit card or in cash on arrival.

Online Payment

Online payment is made when booking on our website with Paypal / credit / debit card (Visa, Visa Electron, Maestro, Mastercard) using a secure payment system.

Payments with American Express or Diners credit cards are not accepted (neither as security nor on arrival).

Bank Transfer

ou can also choose to pay by bank transfer. Please note that the booking is only finally confirmed when the amount has been credited to our account.

Payment by bank transfer is only possible up to 7 days before arrival.

You will receive a confirmation email from us once the amount has been received.

Payment on site in cash

Alternatively, you can pay on arrival in cash (you get a 5% discount if you pay in cash). If you choose to pay on site, we require a security deposit. You will receive an email from us with information on this.

Note

Any irregularity detected in the payment or method of payment (even after full payment), no payment, incomplete or fraudulent payment or evidence of unlawful activity in connection with a payment attributable to the customer or to the customer in collusion with a third party will result in a complete cancellation of the booking, which will be charged to the customer without prior notice and without prejudice to any civil or criminal proceedings that may be brought against the customer.

Deposit

The security deposit, depending on the rental property, is due immediately after booking. This will be refunded after check-out (within a few days) if the flat is in good condition.

For higher amounts, an additional deposit may be requested from us.

Cancellation

Cancellation by the host

The host is entitled to cancel the booking:

Cancellation by the Guest

The cancellation rules are listed separately in the respective rental contracts (or stored in the Internet portal at Booking.com / AirBnb / VRBO / ...).

If no other cancellation rules have been agreed, the accommodation cannot be cancelled free of charge .

If the guest is unable to arrive for personal reasons or if arrival is not possible due to supernatural events such as road blocks, train cancellations or other official instructions, weather conditions or access restrictions, this does not release the guest from his contractual obligations.

If the guest does not wish to/is unable to use the rental property for other reasons, he/she is still obliged to pay the rental price in accordance with the rental agreement.

Cancellation by the guest due to unavailable optional services does not entitle the guest to withdraw free of charge.

The booking is non-transferable, a rebooking to another person must be authorised by the host.

Cancellation by the guest must be notified in writing. Costs already paid for cleaning or tourist tax will not be refunded to the guest.

Complains

Cleaning complaints must be reported by 8 pm on the day of arrival. In the event of a later arrival after 8 p.m., which has been authorised in advance by the host, the host must be informed, in which case the cleaning complaint can be reported on the following day.

The host undertakes to carry out subsequent cleaning/rectification within 24 hours of receipt of the complaint at the latest.

There is no entitlement to subsequent cleaning in the case of minor soiling such as: e.g. pollen, leaves, dust on the balcony/terrace etc. or in the case of complaints reported late

Claims for compensation

A holiday property is rented out, which may be subject to increased wear and tear due to the nature of the rental. Defects that only insignificantly impair the contractual use of the flat, e.g. short-term failure of technical equipment or public utilities, occurrence of ants/spiders/vermin during the rental period due to local climatic conditions, do not entitle the guest to make complaints, reduce the rent or claim compensation. Such occurrences are not foreseeable or avoidable by the host.

Disclaimer of the host

Photos and information on this website are non-exhaustive. Christina's Lago Apartments is not liable for the non-fulfilment or poor performance of the booking due to force majeure, third parties or the customer himself as well as for the failure of the Internet network or for the refusal of the cardholder's bank to pay.

The services to be provided by the host do not include insurance, i.e. the host accepts no liability for theft, fire or water damage to the guest's property or damage to the guest's vehicle.

The host is not liable for circumstances that are not directly related to the rented property, as well as circumstances over which the host has no influence, e.g. beach and local conditions of the holiday resort, weather, noise emissions due to construction or road works, disturbances by third parties, or impairments due to official orders.

If the host is aware that there will be disturbances in or in the immediate vicinity of the flat due to construction sites or construction noise, he will inform the guest. If necessary, the host will offer the guest an alternative accommodation if this is possible (surcharges may be levied for higher quality or better location).

However, claims for damages can only be asserted in the event of wilful or grossly negligent behaviour on the part of the host.

The host accepts no liability for verbal/telephone agreements with third parties. In the event of force majeure, liability for damages is excluded, as the obligations of the contracting parties are suspended and there is therefore no breach of duty or default.

Overbooking and evacuation in the event of force majeure

The landlord reserves the right to relocate guests to an equivalent accommodation depending on availability or to refund the amount paid for the booking in accordance with the remaining term if the booked accommodation is not available for reasons for which the host is responsible (‘overbooking’).
Any additional costs (relating to accommodation and/or transport) between the accommodations will be covered by the host.

Christina's Lago Apartments is not responsible for non-fulfilment due to force majeure events.
Events of force majeure are events generally recognised by the jurisprudence of the Italian courts, unforeseeable and unavoidable phenomena. In this case, Christina's Lago Apartments reserves the right to move all or part of the guests to equivalent accommodation, subject to availability. The guest undertakes to inform the host immediately in the event of force majeure.

Damage occurring during the stay

The guest undertakes to report this to the host immediately. The guest is responsible for all damages caused by him/her in the amount of the replacement/repair costs.
Damages caused by the guest that are not reported by the guest prior to check-out may result in additional service charges and extra costs.

Other

Group bookings

A group booking may be subject to special conditions and/or amendments (including advance payments, penalties and joint liability) which are expressly agreed with Christina's Lago Apartments.

Smoking

Smoking is not permitted indoors in any of the accommodation. Smoking is permitted on the balcony, terrace and in the garden. If any guast is smoking in the accommodation, the host may charge costs for rebooking the next guest and for loss of rent.

Pets

After consultation and authorisation by the host, pets are allowed in some apartements. In any case, however, there is a charge. Depending on the length of stay with a pet, an additional deposit of 50 to 200 euros may be charged.

Any damage caused by the pet to pavements, lawns or inside the accommodation must be rectified immediately by the guest and may be fined by the host or the residence, or by both parties jointly.

Pets are not allowed in or around the swimming pool and must not be left alone in the accommodation at any time. Some resorts may also require your pet to be kept on a lead for safety and hygiene reasons.

Obligations of the guest

The guest is obliged to follow the house rules and pool rules, as well as the host regulations in the house info.

The facilities of the accommodation are to be treated with care and are to be kept clean by the guest during the rental period. Violations of the house rules or pool rules may result in a charge of between 100 and 500 euros, depending on the severity of the offence.
In addition, the host has the right to cancel the rental contract without refund.

Condition, tasks and liability at check-out

The guest is responsible for any damage caused by non-compliance with this rule.

Making claims

Justified claims by the guest arising from complaints can be asserted in writing by the guest up to one month after the end of the stay at the latest if defects were complained about in good time during the rental period and the host has not rectified them within 24 hours.

Applicable law

These general terms and conditions are subject to Italian law for holiday accommodation in Italy.

Changes to the general terms and conditions of sale

Christina's Lago Apartments reserves the right to amend these general terms and conditions of sale in part or in full without prior notice.

Severability clause

If one or more provisions of these General Terms and Conditions are invalid, this shall have no effect on the remaining General Terms and Conditions. In the event of invalid provisions, the relevant statutory provisions shall apply. Several persons of the guest are jointly and severally liable for all obligations arising from these terms and conditions.
